Conditions of Participation

1. Subject matter of the conditions of participation and organizer
These conditions of participation govern the conditions for participation in the competition and any necessary transfers of rights. The description and procedure of the respective competition will be provided as part of the respective competition campaign on the specified Facebook and Instagram pages.The competition organizer is Präbichl Bergbahnen GmbH, Weidauweg 18, 8794 Vordernberg.
By participating in the respective competition, these conditions of participation are accepted.
The competition is not affiliated with Facebook or Instagram and is not sponsored, supported, or organized by Facebook or Instagram.

2. Participation
All persons of legal age who are at least 18 years old and reside in Austria are eligible to participate in the competition. Employees of the competition organizer and persons commissioned by the organizer are excluded. Participation with fake identities or with the identities of third parties is not permitted.
Eligible participants can enter the competition by liking the competition organiser's Facebook and Instagram pages and commenting on the post.
Participation must be submitted by the deadline specified in the post.

3. Prizes and prize notification
The specified prize will be drawn among all eligible participants in a closed draw.
The winners will be determined within one week after the closing date for entries from among all eligible participants. The winners will be notified via Facebook Messenger or Instagram messages and asked to send an email to an email address provided there, in which their personal data is provided completely, correctly, and truthfully. This information will be used to send the prize.
If we do not receive an email from a winner with their personal details (name and address) within the specified period, the prize claim shall expire. In this case, we are entitled to hold a replacement draw.
Only one prize is possible per participant.
The prize is non-transferable and cannot be exchanged or paid out in cash. Please note the validity period of the prize.

4. Granting of rights of use
The participant grants the competition organizer a transferable right to edit, use, and exploit (in particular for advertising purposes) all content created by them and posted on Facebook or Instagram for the purpose of participating in the competition (text, photos, videos, etc.), without any restrictions in terms of time or location. This includes all rights of use and exploitation known under copyright law, including related property rights and the right to assert claims arising from copyright law in court. The contest organizer is entitled in particular to make cuts, changes, deletions, archiving, storage, and technical adjustments to the photos. The participant waives their right to copyright attribution.

5. Liability and indemnification
If the participant uploads photos for the purpose of participating in the competition, the participant guarantees that they will not submit any content whose provision, publication, or use violates applicable law or the rights of third parties.
The participant indemnifies us against any claims by third parties of any kind resulting from the illegality of photos used by the participant. The indemnification obligation also includes the obligation to fully indemnify the organizer against legal defense costs (e.g., court and attorney fees).
By participating in the contest, the participant indemnifies Facebook/Instagram from any liability.

6. Exclusion
Any violation of these conditions of participation entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information or if photos or other content (e.g., comments) used violate applicable law or the rights of third parties. The same applies to comments that can be considered glorifying violence, offensive, harassing, or degrading, or that otherwise violate social decency.
If the excluded participant is a winner who has already been drawn, the prize may be revoked retrospectively.
Comments that violate Facebook and Instagram guidelines, copyright, and Austrian law will be deleted immediately.

7. Early termination and changes
We reserve the right to terminate the competition early, in whole or in part, at any time, even without observing deadlines, or to change its course if it is not possible to guarantee the proper execution of the competition for technical (e.g., computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g., prohibition by Facebook).

8. Limitation of liability
The competition organizer is not liable for damage caused by errors, delays, or interruptions in data transmission, malfunctions of technical equipment or services, incorrect content, loss or deletion of data, or viruses. After the prize has been handed over, the competition organizer accepts no liability for damages of any kind. Any liability for damages or losses resulting from slight negligence is excluded. Furthermore, the competition organizer is only liable in cases of intent and gross negligence.

9. Data protection

We will only use the participant's personal details and other personal data in accordance with the provisions of data protection law. We will only store, process, and use the information to the extent necessary for the purpose of conducting the competition or with the participant's consent. This also includes use for the purpose of exercising the rights of use granted. The data will be used exclusively for the purpose of conducting the competition.

10. Final provisions
Legal recourse is excluded. Cash payment of the prize is expressly excluded. The prize cannot be transferred. Austrian law applies to these terms and conditions of participation.
